La protección provisional del obtentor de una variedad vegetal en el Reglamento (CE) nº 2100/94: delimitación y agotamiento de sus derechos

Abstract

El trabajo desarrolla de forma sistemática un aspecto central para entender la protección provisional como es el agotamiento del derecho. Esta institución del agotamiento tiene un funcionamiento con especialidades muy importantes en sede de obtenciones vegetales respecto del derecho de patentes (véase el art. 16 Reglamento CE 2100/94). El trabajo plantea, en primer lugar, la diferenciación (naturaleza jurídica y funcional) entre las diversas acciones de las que dispone el obtentor tras la concesión del título (art. 94 del Reglamento comunitario), respecto de las limitadas posibilidades de accionar que contempla la norma comunitaria por los actos realizados en protección provisional (art. 95). Esta segunda protección es mucho más limitada y se cohonesta con el carácter constitutivo del título de concesión y la irretroactividad del mismo. La ponderación de la indemnización razonable hace equiparable el cobro de la misma con el canon o royalty del obtentor. Desde las premisas anteriores, el trabajo defiende de forma fundamentada que el cobro de esta indemnización razonable por el periodo provisional viene a agotar el derecho del obtentor.
