Los recursos civiles en el proceso concursal

Abstract

El texto refundido de la Ley Concursal regula con carácter general las insolvencias en el ordenamiento jurídico español. Las resoluciones que, bajo el marco de la norma concursal, dicten Letrados de la Administración de Justicia, Jueces y Tribunales, tienen un régimen de impugnación peculiar. El legislador ha pretendido disciplinar este sistema con sencillez. Sin embargo, existen multitud de controversias que han dado lugar a posiciones doctrinales diversas y a una abundante jurisprudencia sobre la materia. Las causas que han provocado estos problemas interpretativos son muy variadas (p.ej., una regulación fragmentaria y no exhaustiva, el empleo de una técnica legislativa mejorable o la falta de una doctrina jurisprudencial uniforme). Con este trabajo pretende abordar de manera monográfica el estudio del régimen de recursos civiles en el proceso concursal. En primer lugar, se describirán los aspectos esenciales de los recursos en el proceso civil y se expondrán una serie de consideraciones introductorias sobre el concurso; a continuación, se estudiarán las disposiciones generales sobre los recursos civiles en el proceso concursal; y, por último, se analizarán las diferentes disposiciones específicas en materia de recursos que se regulan en el texto refundido de la Ley Concursal, con identificación de las principales discusiones y el planteamiento de posibles soluciones a las mismas.
