Housing constitutes one of the main elements of family assets, which highlights the importance of studying the regime of rented family homes, dealing this paper about some of the main issues of this area, from the approach to the concept of what should be understood by “family home” in this regard. In relation to this tenancy regime, it is important to distinguish between the “physiological” and “pathological” phases of marriage, that is, between the normal course of marriage and the existence of crisis situations (annulment, separation, divorce), considering in relation with the first, whether the tenant’s right is private or community-based, and also dealing with the special regulations that have been issued recently to deal with housing vulnerability; La vivienda constituye uno de los elementos principales del patrimonio de las familias, lo que pone de manifiesto la importancia del estudio del régimen de la vivienda familiar en arrendamiento, ámbito sobre algunas de cuyas principales cuestiones versa el presente trabajo, partiendo del planteamiento del concepto de qué debe entenderse por “vivienda familiar” a ese respecto. En relación con este régimen arrendaticio, es importante distinguir entre las fases “fisiológica” y “patológica” del matrimonio, es decir, entre el devenir normal del matrimonio y la existencia de situaciones de crisis (nulidad, separación, divorcio), planteándonos en relación con la primera si el derecho de arrendamiento tiene carácter privativo o ganancial y tratando igualmente la normativa especial que se ha venido dictando últimamente para hacer frente a la vulnerabilidad habitacional.
