El Reglamento (CE) nº 2100/94 crea un sistema uniforme de protección para las variedades vegetales en todo el territorio de la Unión Europea, eminentemente de corte sustantivo o material, en el que incorpora un régimen especial para la determinación de los tribunales internacionalmente competentes establecidos en los artículos 94 a 100 del ROV y para la solicitud de medidas de ejecución forzosa y tutela cautelar, remitiendo al Convenio de Lugano. Si el encomiable propósito del legislador pudiera ser el de ampliar el alcance territorial de esta norma europea sobre los títulos de obtención vegetal a Estados fuera del territorio de la Unión Europea, en modo alguno puede atribuirse la competencia -precisamente sobre la base de esta norma- a los Estados contratantes que no son parte del ROV. Por este motivo, mas allá de que esta lex specialis garantice, de un modo u otro, siempre un tribunal competente en la Unión Europea para conocer de los litigios derivados de la protección de las obtenciones vegetales con respecto a estas especificas acciones sería conveniente la revisión de algunas de sus disposiciones.

Regulation (EC) No 2100/94 creates a uniform system of protection for plant varieties throughout the territory of the European Union, eminently of a substantive or material nature, in which it incorporates a special regime for the determination of the internationally competent courts established in Articles 94 to 100 of the PVR and for the application for measures of forced execution and precautionary protection, referring to the Lugano Convention. If the legislator's commendable intention may be to extend the territorial scope of this European rule on plant variety rights to States outside the territory of the European Union, in no way can jurisdiction be attributed - precisely on the basis of this rule - to Contracting States that are not party to the ROV. For this reason, beyond the fact that this lex specialis guarantees, in one way or another, that there will always be a court in the European Union with jurisdiction to hear disputes arising from plant variety protection in respect of these specific actions, it would be appropriate to review some of its provisions.
