Reflexiones en torno a la Ley 17/2021, de 15 de diciembre: la protección de los animales como “seres sintientes”

Abstract

Los animales son seres vivos y, como tales, requieren de un régimen jurídico adecuado y respetuoso con su naturaleza. A este respecto, recientemente se ha aprobado la Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales, cuyo objeto es, precisamente, establecer un sistema que ofrezca protección a los mismos. En este sentido, la consecuencia fundamental de la entrada en vigor de esta norma es que los animales dejan de ser considerados como cosas (bienes muebles) y pasan a ser, a efectos legales, “seres sintientes”. En el presente estudio se aborda el análisis de la citada disposición, así como de las principales cuestiones que se derivan

Animals are living beings and, as such, require an adequate legal regime that respects their nature. In this regard, Law 17/2021, of December 15, amending the Civil Code, the Mortgage Law and the Civil Procedure Law, on the legal status of animals, has recently been approved, whose purpose is precisely to offer a system that offers protection to them. In this sense, the real consequence of the entry into force of this rule is that animals cease to be considered things (movable property) and become, for legal purposes, “sentient beings”. Therefore, the present study addresses the analysis of the aforementioned provision, and the main issues that arise.
