La sociedad de gananciales siempre se ha caracterizado por ser un régimen económico que contiene reglas ya definidas para la determinación de la naturaleza de los bienes. No obstante, existen órdenes jurídicos, como el español, que rompen con ese sistema tradicional que reserva únicamente a la ley la atribución de un carácter específico a los bienes del matrimonio, permitiendo a los cónyuges celebrar pactos para atribuir voluntariamente un carácter común o propio a los mismos. En cambio, otros sistemas económico-matrimoniales, como el peruano, no admite tales pactos de atribución y ello se debe a una previsión legal que prohíbe a los cónyuges contratar entre sí sobre sus bienes comunes; sin embargo, la incertidumbre se mantiene en relación con los bienes propios de cada cónyuge a los que no alcanza dicha prohibición. El problema se resuelve con una remisión al Derecho español. Community of property has always been characterized as a matrimonial property regime which contains concrete rules for the determination of nature of matrimonial property. However, there are legal orders, such as Spanish Law, which break that traditional system where the law establishes a specific nature to the matrimonial property and allow spouses to conclude agreements in order to attribute common nature or personal nature to their property. Instead, others matrimonial systems, such as Peruvian Law, does not admit the agreements of attribution because it prohibits spouses to contract each other with respect of their common property. Nevertheless, there is uncertainty about if they can contract each other with respect to their personal property. The problem is solved with a reference to Spanish Law.
