The paper deals with the forms with which in Italy, where it is not recognized the adoption of minors for homosexual couples nor the possibility for these to access assisted procreation, it has given rise to what we could define a “shopping of law and medical assistance” with reference to the possibility of undergoing overseas practices of artificial heterologous insemination with the adoption of the minor by the partner or with transcription of the birth certificate in accordance with the foreign law that recognizes the minor as a child of the couple.
El presente trabajo se ocupa del modo en que en Italia, donde no se reconoce la adopción de menores por parejas homosexuales, ni la posibilidad de que las mismas puedan acceder a la reproducción asistida, ha surgido lo que podríamos denominar un “shopping médico-jurídico”, en relación a la posibilidad de someterse en el extranjero a prácticas de inseminación artificial heteróloga con adopción del menor por parte del partner o con inscripción del acta de nacimiento conforme al Derecho extranjero que reconoce al menor como hijo de la pareja.
