La falacia de las subvenciones sindicales

Abstract

El presente trabajo tiene por objeto investigar si las funciones atribuidas a los sindicatos por la Constitución Española y las leyes están subvencionadas y en qué medida. Para ello se concretan las tareas asignadas a las asociaciones sindicales, se especifica el contenido de cada función y se determina en qué medida están o no subvencionadas. La conclusión es que la mayor parte de las funciones que los sindicatos desarrollan no están financiadas con cargo a los Presupuestos Generales del Estado o de las CC.AA. Son las cuotas de sus afiliados las que contribuyen y mantienen los gastos derivados del diálogo y la concertación social; de la negociación colectiva; del asesoramiento a los trabajadores; del planteamiento de conflictos colectivos e individuales y de las nuevas funciones que la Reforma Laboral encomienda a los sindicatos en las empresas donde no hay representantes de los trabajadores.

This paper aims at investigating whether union’s functions, conferred by the Spanish Constitution and laws, are being subsidized and to what extent. To this end, this paper specifies roles and responsibilities assigned to trade union associations, the content of each role and determines the extent to which these tasks are subsidized or not. The conclusion is that most of the functions that the unions are developing are not financed by the General State Budget or by the Autonomous Communities’ budget. Actually, affiliation fees contribute and support the expenses derived from social dialogue and social consultation; collective bargaining; advice and support services for workers; the formulation of claims of collective and individual conflicts and unions’ new attributions in companies without workers’ representatives conferred by the Spanish Labor Reform
