Legal provisions in the Republic of Argentina order that medical autopsy be performed in all violent or suspected criminality, unless the cause of death is evident in the external examination. Numerous international bibliography indicates the high degree of diagnostic error of the described procedure. We present a case of diagnosis of wrong cause of death, then clarified in medical autopsy, review of bibliography and considerations about the findings and legal consequences.
