La propuesta de Directiva de insolvencia establece un marco comunitario mínimo armonizado sobre procedimientos de reestructuración preventiva, segunda oportunidad y medidas para aumentar la eficacia de los procedimientos de condonación, insolvencia y reestructuración. La Directiva propuesta pretende: reducir el número de despidos debidos a la insolvencia de empresas, crear un marco comunitario más seguro para las inversiones entre países, convertir créditos dudosos en créditos sin incumplimientos y permitir a los empresarios reemprender su actividad empresarial tras la insolvencia.
The insolvency Directive proposal sets up a minimum harmonised Community framework on preventive restructuring proceedings, second chance and measures to increase the efficiency of restructuring, insolvency and discharge procedures. The proposed Directive aims at: cutting down the number of jobs lost due to bankruptcy, bringing more legal certainty for cross-border investors, turning bad debt into performing credit, and allowing entrepreneurs to restart business activities after insolvency.
