La posible aplicación del art. 1.902 C.c. español para indemnizar los daños entre familiares ha sido una cuestión muy discutida. En los últimos quince años los Tribunales españoles se han enfrentado a un novedoso grupo de casos, el de los daños derivados de la ocultación de la verdadera paternidad biológica, concediendo indemnización y dando así entrada a la responsabilidad civil en el ámbito de las relaciones familiares, exigiendo, en la mayoría de las ocasiones, la culpa grave o el dolo como criterio de imputación.
The possible application of the article 1.902 Spanish Civil Code to compensate the damages between relatives has been a very controversial question. In the last fifteen years the Spanish Courts have faced a new group of cases, damages derived from the concealment of the true biological paternity, giving compensation and allowing by this way the entry of the tort law in the area of the familiar relations, requiring, in the majority of the occasions, the gross negligence or wilful misconduct as criterion of imputation.
