Abstract

La incapacitación supone la privación de la capacidad de obrar de una persona por las causas señaladas en la ley. Son causas de incapacitación las enfermedades o defi ciencias persistentes de carácter físico o psíquico, que impidan a la persona gobernarse por sí misma. La drogodependencia no fi gura como causa directa de incapacitación, pero puede dar lugar a enfermedades o defi ciencias físicas o psíquicas que determinen una incapacitación del drogodependiente si no puede gobernarse por sí mismo, como así se ha recogido en la jurisprudencia de nuestros Tribunales. La incapacitación de una persona sólo se puede declarar por sentencia judicial, en donde se establecerá el alcance de la misma (total o parcial), siendo revisable, ya que no tiene efi cacia de cosa juzgada, puesto que las condiciones físicas o psíquicas del drogodependiente incapaz pueden variar. Cabe también la posibilidad de un internamiento involuntario en caso de que el consumo de sustancias tóxicas diere lugar a un trastorno psíquico, que requiere autorización judicial previa, excepto en el caso de que se trate de situaciones de urgencia, debiéndose en este caso dar cuenta de éste al tribunal competente lo antes posible, para que pueda ratifi car dicho internamient

Incapacitation involves the loss of a person's legal capacity to act for the reasons outlined in the law. Causes of incapacitation are illness or persistent physical or psychic defi ciencies, preventing the person from governing him or herself. Drug addiction is not listed as a direct cause of incapacitation, but can give rise to diseases or physical or mental defi ciencies that determine an incapacitation of dependents if they cannot govern themselves, as has been shown in the jurisprudence of our Courts. The incapacity of a person can only be declared by court order, where its (total or partial) scope has to be established, on a reviewable basis, since it has no res judicata effi cacy, as the incapable dependent's physical or mental conditions may vary. There could also be cases of involuntary internment in the event of the consumption of toxic substances giving rise to a mental disorder, which requires prior judicial authorization, except in the event of involving emergency situations. In this case the competent court should be informed of this as soon as possible, so that any such internment can be ratifi ed.
