¿Es posible invocar la excesiva onerosidad como excusa de la falta de cumplimiento de acuerdo con la CISG?

Abstract

A fin de evitar una posible integración judicial que dé como resultado una gran variedad de soluciones que difícilmente conduzcan a una respuesta uniforme, el presente artículo analiza la posibilidad de invocar la figura de la excesiva onerosidad en el ámbito de la CISG, sobre la base de la aplicación de su artículo 79 que regula el régimen de exención de responsabilidad, haciendo hincapié en los presupuestos necesarios para declarar su existencia y en las consecuencias jurídicas derivadas de su aplicación.

To avoid possible legal integration that results in a variety of solutions that hardly lead to a uniform response, this paper analyzes the possibility of invoking situations of hardship within the scope of the CISG, based on the application of article 79 that regulates the exemption of liability in the event that non-performance is due to an impediment beyond the debtor's control, emphasizing the conditions required to declare its existence and the legal consequences of its application.
