La incapacitación supone la privación de la capacidad de obrar de una persona por las causas señaladas en la ley, que sólo se puede declarar por sentencia judicial. Son causas de incapacitación las enfermedades o deficiencias persistentes de carácter físico o psíquico, que impidan a la persona gobernarse por sí misma. En la sentencia se establecerá el alcance de la incapacitación (total o parcial), siendo revisable, ya que no tiene eficacia de cosa juzgada, puesto que las condiciones físicas o psíquicas del incapaz pueden variar.
Incapacitation involves deprivation of the legal capacity of a person by causes indicated in the law, which can only be declared by judicial decision. Causes of incapacitation are illness or persistent physical or psychic deficiencies, preventing the person to govern itself. In its judgment the scope of incapacitation (total or partial), will be established being reviewable, since it has no efficacy of res judicata, since conditions physical or psychic of the incapable may vary.
