Abstract

Nos encontramos en un momento histórico caracterizado por un cambio social fruto de la revolución tecnológica que conlleva la transformación de las relaciones jurídicas existentes, planteándosele al legislador un nuevo reto a superar y la necesidad de buscar nuevas formas alternativas a la justicia que garanticen la existencia de entidades u organismos que solucionen los conflictos, respetando la neutralidad que, en razón del choque de intereses contrapuestos, ya no se reconoce en muchas ocasiones a los Tribunales locales. Las denominadas nuevas tecnologías de la información y de la comunicación (NTICs) en general, y en especial Internet, otorgan la posibilidad de un acceso directo del ciudadano a la mayor parte de la información sin limites de tiempo ni de espacio, contribuyendo como herramienta base a potenciar y a multiplicar los efectos de las distintas globalizaciones (globalización del comercio, de los mercados, de la emigración, de la cultura, tendencia a la universalización, etc.). Como apunta Muñoz Machado, «la conclusión que interesa dejar establecida es que la globalización es un fenómeno tan real como problemàtico». Se hace necesario ahora proceder a nuevas regulaciones, a dotar de un nuevo sentido a las diferentes normas que han regido hasta el momento y que con la llegada de la globalización cobran una concepción diferente que debe plasmarse.
