Abstract

La actual regulación del derecho de asilo conserva los principales caracteres sobre los cuales se configuró. Las demandas por razones de género quedaban excluidas ante el difícil encaje en dicho sistema. Su evolución se ha manifestado a través de leves modificaciones que han permitido una interpretación por parte de los operadores jurídicos más favorable a la inclusión de estas demandas específicas. La mutilación genital femenina ha sido uno de los casos en los que los tribunales han entendido la necesidad de regulación. No obstante, algunos obstáculos siguen existiendo. Los últimos textos legales han incluido algunas de las positivas consecuencias de la evolución, sin llegar a alterar sustancialmente el sistema. Por esta razón, la evolución ha sido insuficiente.

Currently, asylum law keeps the main characters on which it was configured. Asylum claims based on gender reasons were excluded from this protection, due to this male configuration, and the difficulties to fit in it. We can prove its evolution through slight modifications, through which decision bodies are allowed to interpret their characters in a more gender sensitive manner, and grant asylum to these women. Female genital mutilation has been one of this cases, in which courts have affirmed the need for a specific regulation. Nevertheless, some obstacles still remain. The last legal documents have included some of the positive consequences of that evolution, without changing the fundamentals. So, we can say that evolution has been insufficient.
