Drogas, delincuencia y enfermedad mental

Abstract

Este trabajo trata de dar una visión de la situación de los drogodependientes que padecen enfermedad mental y que delinquen, analizando tanto la etiología delictiva como su peligrosidad social, así como las consecuencias penales que conlleva. Se diferencia entre los drogodependientes que llegan al delito como consecuencia del consumo de drogas de los que ya delinquían antes de ser consumidores, siendo el consumo un paso más dentro de su proceso de desestructuración e inadaptación social. Se estudia los diferentes tipos de delincuencia en relación con las drogas. Se analiza el perfil de los drogodependientes y de los que ingresan en prisión, teniendo en cuenta su patología psiquiátrica. Se contempla la regulación en España de la imputabilidad, semiimputabilidad, la enajenación mental, la peligrosidad y las medidas de seguridad, prestando especial atención a la de internamiento. Finalmente se estudia su ingreso en los centros psiquiátricos penitenciarios o de deshabituación y el funcionamiento de los mismos.
