Abstract

Riesgo es la contingencia de un daño. Contingente es aquello que puede ser y puede no ser. Contingencia se opone a imposibilidad y necesidad, porque contingente es aquello que no es ni imposible ni necesario. De la misma manera, los antónimos de riesgo son seguridad y certeza. Estos binomios contingencia/necesidad y, sobre todo, riesgo/seguridad son los que elegiría cualquier jurista especializado para comenzar a hablar del derecho del riesgo en las sociedades contemporáneas. En este trabajo, sin embargo, nos apartaremos de este camino y seguiremos otro más arriesgado. Construiremos el concepto de riesgo a partir de la diferencia riesgo/peligro y después valoraremos que trascendencia puede tener ese otro enfoque para la teoría de sistemas jurídicos. Abstract Risk is the contingency of a damage. Contingent is something that could be or not could be. Contingency is opposed to impossibility and necessity, because contingent is something that is neither impossible nor necessary. That is the reason because risk antonyms’s are security and certainty. These binomials contingency/necessity and risk/security are those who would be choose by any specialized jurist to begin to talk about the risk law in contemporary societies. Nevertheless, in this work, we don’t gconcept of risk from thetheory of legal systems.
