Abstract

Constituye un estudio de la delimitación de los dos ámbitos de la responsabilidad civil, la contractual y la extracontractual, tarea que aparentemente, a tenor de los arts. 1101 y 1902 CC parece sencilla, pero que deviene compleja, atendiendo a la amplitud de la fórmula del art. 1902 CC y al constatar la existencia de zonas grises o intermedias donde el daño no se produce como consecuencia del incumplimiento de deberes contractuales esenciales, sino de especiales deberes de cuidado, implícitos en el contrato. La trascendencia de calificar adecuadamente un supuesto de hecho como de responsabilidad contractual o extracontractual se pone de relieve al analizar las diferencias existentes entre los dos regímenes jurídicos, con abundantes referencias jurisprudenciales. Al tiempo, se aborda la cuestión de la concurrencia o yuxtaposición de responsabilidades desde la perspectiva procesal, haciendo un repaso a las diversas teorías que ha seguido el Tribunal Supremo desde hace décadas (concurso de normas, concurso de acciones o pretensiones, concurso alternativo de acciones u opción, doctrina de la "rigurosa órbita de lo pactado y como preciso desarrollo del contenido negocial", teoría de la unidad de la culpa civil etc.), pero sin decantarse claramente por un criterio definido, movido en ocasiones por la búsqueda de un resultado de justicia material, poniendo de relieve, al tiempo, las consecuencias que puede tener para el perjudicado fundamentar su demanda solo como un problema de responsabilidad contractual o como un problema extracontractual (arts. 218 y 400 LEC).
