La jurisprudencia del TEDH sobre las uniones de hecho

Abstract

A lo largo del presente texto analizaremos la posición del Tribunal Europeo de Derechos Humanos (TEDH) respecto de las uniones de hecho, comparándola con la que ha adoptado en relación con los matrimonios. Dada cuenta de las particularidades que presenta la jurisprudencia de la Corte de Estrasburgo, comenzaremos haciendo una breve referencia al Convenio Europeo de Derechos Humanos (CEDH) y al TEDH. Así mismo, haremos especial mención al margen de apreciación nacional, precisamente por la importancia que tiene el mismo en las sentencias que resuelven este tipo de asuntos. A continuación expondremos un estudio sistematizado del derecho a contraer matrimonio (art. 12 CEDH) y del derecho a la protección de la vida familiar (art. 8 CEDH) de las parejas de hecho, atendiendo a la diferente respuesta que ha dado el TEDH según que los sujetos activos sean personas de distinto sexo, del mismo sexo o transexuales. Tras ello, comprobaremos si es preceptivo o no que los Estados reconozcan el mismo estatus jurídico a las parejas de hecho que a las casadas. Y, por último, expondremos una serie de conclusiones extraídas del estudio jurisprudencial.
