Abstract

Estas páginas recogen el reconocimiento y configuración del derecho de acceso a la justicia desde la Declaración Universal de los Derechos Humanos, que estableció su base en 1948, hasta su reconocimiento con esta denominación en la Convención de Derechos de las Personas con Discapacidad de 2006. Constituye un derecho humano fundamental para defender el resto de derechos y, sin embargo, descubrimos en los ordenamientos internos lagunas y debilidades que impiden alcanzar su plena garantía. Analizamos los documentos secundarios, no vinculantes, de Naciones Unidas (NNUU) que ponen de manifiesto el conocimiento de las dificultades y se proponen soluciones para garantizarlo universalmente, especialmente a grupos vulnerables. Entre estos documentos destacamos las Observaciones Generales de los Comités de NNUU y los informes elevados a la Asamblea General y al Consejo de Derechos Humanos por los Relatores Especiales y por el Alto Comisionado de Naciones Unidas para los Derechos Humanos en los que exponen las dificultades para el ejercicio pleno de este derecho y proponen soluciones para superarlas.

These pages cover the recognition and configuration of the right of access to justice from the Universal Declaration of Human Rights, which established its foundation in 1948, to its recognition under this name in the 2006 Convention on the Rights of Persons with Disabilities. It constitutes a fundamental human right for the defense of other rights, yet we discover gaps and weaknesses in domestic legal systems that prevent its full guarantee. We analyze secondary, non-binding United Nations documents that demonstrate awareness of the difficulties and propose solutions to guarantee it universally, especially for vulnerable groups. Among these documents, we highlight the General Comments of the United Nations Committees and the reports submitted to the General Assembly and the Human Rights Council by the Special Rapporteurs and the United Nations High Commissioner for Human Rights, in which they outline the difficulties in the full exercise of this right and propose solutions to overcome them
