Abstract

Neste artigo eu colocar em evidência um certo número de limitações de ordem epistemológica e conceitual que apresenta a categoria jurídica internacional dos direitos sexuais e reprodutivos. Estas limitações determinam em grande parte a sua (in)eficácia na prática, especialmente quando se trata de cobrir e proteger toda a extensão das experiências das mulheres na esfera reprodutiva e, portanto, eu acho que devem ser tidas em conta no momento de transferir as normas legais internacionais – ou os princípios que contêm - para os ordenamentos jurídicos internos, ou apenas a tempo para implementar essas normas.

En este artículo pongo de manifiesto una serie de limitaciones de orden epistemológico y conceptual que presenta la categoría jurídico internacional de los derechos sexuales y reproductivos. Estas limitaciones determinan en buena medida su (in)eficacia en la práctica, sobre todo a la hora de abarcar y proteger en todo su alcance las experiencias de las mujeres en el ámbito reproductivo y, por ello, creo que deben ser tenidas en cuenta al trasladar las normas jurídicas internacionales —o los principios que estas contienen— a los órdenes jurídicos internos o, simplemente, al tratar de aplicarlas.

In this article we show a number of limitations of epistemological and conceptual kind which offers the international legal category of sexual and reproductive rights. These limitations largely cause its (in) effectiveness in practice, especially when it comes to cover and protect the full implications of the experiences of women in the reproductive sphere and therefore, we believe that it must be taken into account to transfer the international legal standards – or the principles that they contain – into the domestic legal orders or simply, trying to apply these standards.
