Este trabajo aborda el uso de ordenadores personales y de material informático por los internos en un centro penitenciario, posibilidad que, aunque está expresamente contemplada en el art. 129 RP, no ha sido lo suficientemente estudiada por la doctrina, a buen seguro debido a que dicha posibilidad está muy restringida en la práctica y no suele plantear problemas en el día a día de la mayoría de los internos. No obstante, nuestro estudio va más allá del uso de ordenadores personales y de material informático por los internos en un centro penitenciario y se extiende también al uso de teléfonos móviles, de tabletas digitales (tablets), de lectores digitales de libros electrónicos (e-books), y de internet. Asimismo, se aborda el uso de estos dispositivos, no solo por razones de carácter educativo o cultural que lo hagan necesario o aconsejable para el desarrollo de los correspondientes programas formativos, que es la única razón que actualmente se contempla en el art. 129 RP, sino también para el ejercicio del derecho a la defensa, para el cumplimiento de la sentencia y/o para otros usos, razones que, a nuestro juicio, justifican igualmente que estos dispositivos, con las debidas garantías, puedan ser utilizados por algunos internos de los centros penitenciarios de nuestro país.
This paper deals with the use of personal computers and computer equipment by inmates in a prison, a possibility that, although it is expressly contemplated in art. 129 PR, has not been sufficiently studied by the doctrine, surely because this possibility is very restricted in practice and does not usually pose problems in the day-to-day life of most of the inmates. However, our study goes beyond the use of personal computers and computer equipment by inmates in a prison and also extends to the use of mobile phones, tablets, e-book readers and the internet. Likewise, the use of these devices is addressed, not only for educational or cultural reasons that make it necessary or advisable for the development of the corresponding training programs, which is the only reason currently contemplated in art. 129 RP, but also for the exercise of the right to defence, for the fulfillment of the sentence and/or for other uses, reasons that, in our opinion, also justify that these devices, with due guarantees, can be used by some inmates of our country's prisons.
