La caducidad del procedimiento: su repercusión en la posición jurídica del interesado

Abstract

La caducidad del procedimiento administrativo, según que se inicie de oficio o a instancia del particular y en función de a quién sea imputable la paralización –a la Administración o al interesado, respectivamente-, va a generar posiciones subjetivas diversas para cada una de las partes de la relación jurídico-administrativa. En todo caso, en estos supuestos el derecho del interesado al trámite se enerva, dando paso, según el caso, bien "al derecho a la no tramitación del procedimiento", bien a una posición de sujeción a la tramitación. En el trabajo se analiza el alcance de dichas posiciones en cada uno de los casos señalados.
