Más allá del ya reconocido modelo rehabilitador en las prisiones del ámbito del Consejo de Europa, recientemente ha aparecido importante jurisprudencia relativa al tratamiento penitenciario. El asunto de Murray contra los Países Bajos (STEDH, Gran Sala, 2016) determinó el incumplimiento del artículo 3 del Convenio Europeo, debido a una ausencia de tratamiento penitenciario. Analizamos cuál es su alcance, si de la misma se derivan obligaciones para los estados y qué otras acciones de tratamiento penitenciario pudieran tener vinculación a jurisprudencia del Tribunal Europeo de Derechos Humanos.
Beyond the already recognized rehabilitation model in prisons throughout the Council of Europe, we are going to revise here recent case law on penitentiary treatment. According to the case of Murray v. The Nederlands, in 2016, a violation of article 3 of the European Convention was declared, due to the absence of penitentiary treatment. We analyse its scope, the state obligations from this case and what other actions on desistance could fall in previous judgments.
