La finalidad de este trabajo consiste en exponer el fenómeno de los impuestos de salida, conocidos en Derecho Comparado como exit taxes y su incidencia en el ordenamiento español. Estudiaremos la presencia de la imposición directa a la emigración dentro de la Ley del Impuesto sobre las Personas Físicas y en la Ley del Impuesto sobre Sociedades, no sin dejar de hacer un análisis crítico respecto a su fundamentación y los límites impuestos desde la óptica constitucional, y más importante, desde el ordenamiento europeo. La incidencia de las libertades fundamentales previstas en el Tratado de Funcionamiento de la Unión Europea y su desarrollo jurisprudencial nos resultará indispensable para comprender el alcance de la problemática.

The aim of this paper is to expose the phenomenon of migration taxation, more known throughout different legal systems as exit taxes, and their presence in the Spanish legal system. We will study how are these taxes present in the Spanish IRS and legal person taxation statutes, though not without performing a throughout analysis regarding their legal justification and the limits that would arise from constitutional and EU law. The presence of fundamental rights arising from the Treaty of Functioning of the European Union, and to be more precise, arising from article 49 TFEU, and its case-law development regarding this matter, will be of utmost importance to understand the scope of the main issue presented.
