RESUMEN: La justicia premial es un modelo que irrumpe en Colombia y tiene antecedentes en la figura del plea bargaining estadounidense. En la justicia premial se encuentran dos discursos acerca de la verdad en el Derecho Penal que se inscriben en concepciones filosófico-jurídicas diversas; Por un lado, se encuentra el consensualismo de la verdad que pretende llegar a acuerdos participativos y en igualdad de condiciones; por el otro, se encuentra un modelo sistemático de garantías que epistemológicamente retoman la verdad como correspondencia. Este trabajo trata de realizar un examen de la justicia premial a la luz de ambas concepciones filosófico-jurídicas para precisar si esta puede o no inscribirse en alguna, o si, por el contrario, posee su propia concepción de la verdad.

ABSTRACT: The reward justice is a model that brakes in Colombia and has antecedents in the figure of U.S the plea bargaining. In the reward justice finds two discourses about the truth in the penal law that inscribes in many philosophical-juridical conceptions; by one side, find the consensualism of true that pretends to approach a participative in agreements in equal conditions; by the other side, finds a systematic model of guaranties that takes the truth epistemologically like a correspondence. This paper tries to make an exam of the reward justice under the light of the both philosophicaljuridical conceptions to clarify if this could or not to inscribe in any, or if, by the other way, has his own true conception.
