Abstract

RESUMEN: La justicia transicional es la propuesta para situaciones de emergencia prolongada en los regímenes políticos o para la negociación de conflictos armados internos o internacionales de extendida duración. El énfasis en dos estándares internacionales-obligación de sancionar los graves crímenes y la participación política del enemigo del Estado- es el eje del cuerpo de la tesis, señalando observaciones críticas y nuevos dilemas de orden jurídico y político. Asuntos problemáticos que se trasforman en otro campo de discusión de elevado interés constitucional e internacional."
