El derecho constitucional a la prueba judicial

Abstract

RESUMEN: El presente estudio tiene la finalidad de presentar el derecho a la prueba en la jurisprudencia de la Corte Constitucional colombiana, analizando su fundamentalidad, su configuración legal y sus límites constitucionales y legales, acompañándose esto de construcción doctrinaria en lo tocante a los derechos fundamentales y el derecho a la prueba propiamente dicho; lo cual se logró a través de revisión documental y análisis jurisprudencial. Con base en los hallazgos, se concluye que el derecho a la prueba es un derecho constitucional fundamental, pues su violación genera causal de procedibilidad de acción de tutela contra sentencias judiciales por defecto fáctico, con base en subreglas jurisprudenciales que constituyen precedente en el sistema jurídico colombiano; asimismo, es protegible constitucionalmente al interior del proceso judicial. De igual manera, el derecho a la prueba se manifiesta en cada una de las fases de la actividad probatoria, esto es, en el aseguramiento, solicitud, admisión, decreto, práctica y valoración probatoria; y admite limitaciones como la pertinencia, conducencia, utilidad, legalidad y licitud de la prueba.
