RESUMEN: El presente trabajo pretende analizar las dificultades teóricas, fácticas y legales que se derivan de asumir el proceso judicial en términos epistemológicos. El carácter de los hechos en la relación jurídicoprocesal está determinado por las pretensiones de las partes, las exigencias del proceso y el fin de la prueba; por tanto, la búsqueda de la verdad es un propósito difícil de satisfacer de modo pleno en la decisión judicial porque depende de variables no controlables por los sujetos procesales. Así, la etapa probatoria consiste en un enfrentamiento de subjetividades que está sometida a la reconstrucción de los hechos en el proceso
ABSTRACT: This paper aims to analyze the theoretical, factual, and legal difficulties that arise when studying legal proceedings on pistemological grounds. The nature of facts within the framework of trials is determined by the parties’ claims, procedural requirements and the purpose of evidence. Therefore, it is difficult to satisfy fully the quest for truth in a judicial opinion because it depends on variables that cannot be controlled by those who participate in the proceedings. Thus, assessing evidence involves a confrontation of personal interests and it is in turn dependent upon the reconstruction of facts in a legal process.
