Abstract

RESUMEN: Este artículo aborda la problemática del alcance del efecto de la nulidad en un contrato que se encuentra vinculado con otros a través de la conexidad. Se comienza con una caracterización de la contratación conexa; para continuar con el régimen de las nulidades de los negocios jurídicos privados en el ordenamiento jurídico colombiano y finaliza con el análisis y la propuesta sobre el efecto que despliega la nulidad sobre un sistema negocial complejo cuando se invalida uno de los contratos parte. Se pretende sistematizar los criterios de existencia de la conexidad contractual y exponer de los posibles efectos los concernientes a la validez de los contratos, por ser el panorama más problemático a la luz del principio de legalidad. Se concluye que la nulidad que afecta a un contrato ligado a una red contractual, solo puede extender su efecto en la medida que afecte la causa de la vinculación. Este escrito es el producto de una investigación cualitativa con un enfoque dogmático, de técnica documental especializada.

ABSTRACT: This article discusses the effect of nullity in a contract that is linked to others in a contractual networking. It begins by characterizing the contractual network to continue with the regime of nullities in the Colombian private law system and ends by analyzing and proposing the effect that the nullity displays on a complex business system (contractual networking) when one of the part contracts is invalidated. The aim is to systematize the criteria for the existence of contractual networking and to expose the possible effects on the validity of contracts, since this is the most problematic scenario in light of the principle of legality. It is concluded that the nullity that affects a contract linked to a contractual network, can only extend its effect when it undermine the contractual networking cause. This writing is the product of a qualitative research with a dogmatic approach with a specialized documentary technique.
