Abstract

El artículo presenta y discute los dos principales modelos de reconstrucción de la teoría del de lito con base en la teoría de las normas. Ante la imposibilidad de decantarse por uno de ellos en términos lógicos, pues ambos son igualmente válidos en ese as pecto, se defiende la preferencia de uno de ellos con base en criterios heurístico-jurídicos

This paper presents and discusses the two main models of the reconstruction of the theory of crime based on the theory of norms. Given the impossibility of choosing one of them in logical terms, as both are equally valid in that regard, the preference for one of them is argued based on heuristic-legal criteria
