La adopción por personas con discapacidad

Abstract

Conforme al artículo 23.2 de la Convención de Naciones Unidas de los Derechos de las Personas con Discapacidad (CDPD) los Estados partes garantizarán los derechos y responsabilidades de tales personas en relación a la adopción de menores. Tal precepto ha sido de escasa aplicación práctica por la existencia de un prejuicio tradicional hacia la sexualidad y la maternidad/paternidad de estas personas, habiéndose llegado incluso a afirmar que sus hijos/as biológicos/as deberían darse en adopción. El presente trabajo se centra en el análisis de la configuración de la adopción en el citado artículo 23.2 CDPD, a partir de significativos ejemplos de Derecho Comparado. Primero, se estudian las condiciones de salud o económicas exigidas a los adoptantes, en las que subyace con frecuencia una discriminación directa o indirecta hacia las personas con discapacidad. Segundo, se profundiza en el significado del concepto “apoyo”, dirigido a asegurar que las personas con discapacidad puedan adoptar en iguales condiciones que las demás. Tercero, el trabajo ahonda en el alcance de la expresión “se velará al máximo por el interés superior del niño”, de cara a examinar si la misma compromete la eficacia del artículo 23.2 CDPD en la práctica

According to Article 23 of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) States Parties shall ensure the rights and responsibilities of such persons with regard to adoption of children. This article has a limited application in practice due to a traditional prejudice towards sexuality and motherhood/parenthood of these people, even proposing the adoption of their biological children. This contribution focuses on the analysis of the configuration of adoption in the aforementioned Article 23.2 CRPD, based on significant examples of Comparative Law. First, it studies the health and financial requirements for adopters, which often hide direct or indirect discrimination against people with disabilities. Second, this paper explores the meaning of the concept of “support”, which is aimed at ensuring that persons with disabilities can adopt on an equal basis with others. Third, it analyzes the scope of the expression “in all cases the best interests of the child shall be paramount”, with a view to examining whether it jeopardises the effectiveness of Article 23.2 CRPD in practic
