Abstract

La Corte Internacional de Justicia es el centro solar del arreglo judicial de controversias interestatales. El número y variedad de los asuntos que le son sometidos y los perfiles de los Estados partes han aumentado considerablemente en los últimos treinta años. Dentro de este marco interesa acercarse a la composición de la Corte, examinando, primero, a los que su Estatuto califica como sus miembros y, a continuación, a los denominados jueces ad hoc, así como los vasos comunicantes entre una y otra condición y las fisuras que amenazan el principio de igualdad de armas que debe inspirar los procedimientos ante la Corte. El relato concluye con unas observaciones sobre la productividad de la Corte, su mirada del Derecho Internacional y la relación entre policies y prejuicios, y su papel eminente en la interpretación de normas generales

The International Court of Justice is the most important centre of the judicial settlement of inter-State disputes. The number and variety of cases submitted to it and the profiles of the States parties have increased considerably over the last thirty years. Within this framework, it is interesting to look at the composition of the Court, examining, first, those that its Statute qualifies as its members, and then the so-called ad hoc judges, as well as the relationship between one status and the other and the fissures that threaten the principle of equality of arms that should inspire proceedings before the Court. The account concludes with observations on the Court’s productivity, its look of international law, the risks of mixing policies and prejudices, and its eminent role in the interpretation of general norms
