Abstract

El presente estudio analiza los aspectos más relevantes de las sanciones en el estado de alarma. Tras destacar la ausencia de un régimen sancionador en las normas que regulan y declaran dicho estado y el abuso que hacen de las remisiones, se analiza la diferencia entre el incumplimiento de las normas de conducta y la desobediencia a las órdenes de la autoridad, se critica la subsunción de dichos incumplimientos en la legislación de seguridad ciudadana y se aboga por su reconducción al ámbito de la salud pública. Tras ello, se destaca la posibilidad de que los Reales Decretos que declaran el estado de alarma incluyan su propio régimen sancionador y, por último, se indican algunas pautas para configurar un régimen sancionador más apropiado a las situaciones de emergencia

This paper analyzes the most relevant aspects of sanctions in the state of alarm. After highlighting the absence of a sanctioning regime in the legislation that regulate and declare the state of alarma and the abuse of referrals, the difference between the breach of the rules of conduct and the disobedience to the orders of the authority is analyzed, the subsumption of said breaches in the citizen security legislation is criticized and it is advocated for their redirection to the public health legislation. After that, the possibility is highlighted that the Royal Decrees that declare the state of alarm include their own sanctioning regime and, finally, some guidelines are indicated to configure a legal sanctioning regime more appropriate to emergency situations
