Si las leyes de transparencia limitaran su ámbito de aplicación a las entidades y órganos del sector público, una simple decisión organizativa por parte de estas entidades, en el sentido de externalizar o privatizar de servicios y funciones públicas, supondría una merma injustificable del derecho de acceso a la información pública, en relación con una actividad que materialmente no deja de ser pública por la mera circunstancia de su desempeño por un sujeto privado. En este contexto se sitúa el artículo 4 de la Ley estatal de transparencia, cuando obliga a determinadas personas privadas a suministrar información a las entidades y órganos públicos. Sin embargo, el precepto es de redacción confusa y plagado de conceptos indeterminados, todo lo cual repercute negativamente en su efectividad
If laws regarding transparency limited their application to organizations from the public sector, a simple organizational decision of these organizations regarding the outsourcing or privatization of services and public functions would suppose an unjustifiable reduction of the right to access public information related to an activity which is still of public property, in spite of being carried out by a private entity. In this context the article 4 of the state law on transparency is established, forcing private organisms to provide information to public bodies, nevertheless the precept's redaction is confusing and saturated with indefinite concepts affecting negatively its efficacy
