The largest number of crimes related to public corruption are committed in regard with public procurement in the field of local administration. From the perspective of criminal law the offences usually committed are those of perverting the course of justice by civil servants (“prevarication”), prohibited negotiations and briberies. Additionally in these cases, an administrative sanction can be imposed, due to the fact that these wrongdoings may be also considered administrative offences. On the other hand, Spanish courts use a broad concept of "civil servant" for the purposes of charging these offences to their perpetrators, including here the directors or managers of joint ventures
Las mayores cifras delictivas relacionadas con la corrupción pública se producen en relación con la contratación pública en el ámbito de la Administración local. Desde la perspectiva del Derecho penal los delitos que más aparecen en esta materia son los de prevaricación, negociaciones prohibidas y cohecho, y en estos casos, además, puede imponerse una sanción administrativa, ya que estas conductas constituyen también infracciones administrativas. Por otro lado, los tribunales españoles sostienen un concepto amplio de “funcionario público” a efectos de declararle autor de estos delitos, incluyendo aquí a los directores o gerentes de empresas mixtas
