El blanqueo: Concepto y lesividad

Abstract

El artículo trata de contribuir a despejar las muchas incertidumbres que suscita la interpretación del delito del blanqueo respondiendo a las dos preguntas básicas de qué es el blanqueo y cuál es su lesividad. Blanquear no es realizar cualquier conducta con los bienes procedentes de un delito sino solo actos cuya funcionalidad específica o preferente sea la de ocultar o encubrir tal origen ilícito. Estas conductas son disvaliosas desde varios puntos de vista. En primer lugar, contribuyen al daño al bien jurídico del delito del que proceden los bienes blanqueados, creando un escenario fértil para tales delitos, obstaculizando su persecución e intensificando su daño propio cuando son patrimoniales. Además, el blanqueo daña el sistema económico, al constituir una suerte de competencia desleal. Finalmente, puede coadyuvar al nocivo poder de las organizaciones criminales, facilitándoles vías de influencia aparentemente legales

The article tries to contribute to clear the many uncertainties that arise from the interpretation of the crime of laundering by answering the two basic questions of what is money laundering and what is its harmfulness. Whitening is not to conduct any conduct with the goods coming from a crime but only acts whose specific or preferred functionality is to conceal such illicit origin. These behaviors are disparate from several points of view. In the first place, they contribute to the damage to the legal good of the crime from which the bleached goods come, creating a fertile stage for such crimes, hindering their persecution and intensifying their own damage when they are patrimonial. In addition, money laundering damages the economic system, as it constitutes a kind of unfair competition. Finally, it can contribute to the harmful power of criminal organizations, providing them with seemingly legal avenues of influence
