Duplicidades funcionales de Comunidades Autónomas y entidades locales

Abstract

La crisis económica está llamando la atención sobre un posible exceso de gasto público derivado de que dos o más Administraciones públicas realicen las mismas o similares tareas. En este estudio se analiza esa realidad, se busca una explicación y se proponen posibles vías de solución. Primeramente se diferencian las llamadas «duplicidades» de otras realidades próximas: actividades «impropias» y «gastos no obligatorios» locales. A continuación se identifican las duplicidades fundamentalmente en los ámbitos propios del Estado social (educación, cultura, servicios sociales, salud, etc.) y en la promoción económica. La explicación de las duplicidades se concreta en que las distintas Administraciones públicas tienden a realizar las actividades de mayor relevancia política, siempre que cuenten con capacidad de gasto suficiente y no haya límites competenciales que lo eviten. En Derecho español no sólo no hay límites competenciales que eviten las duplicidades entre Comunidades Autónomas y entidades locales sino que estructuralmente se acepta el resultado duplicativo. Las posibles soluciones a las duplicidades son de tres tipos: simplificación unilateral (por simple reducción del gasto o mediante medidas autonómicas de coordinación); simplificación convencional (mediante acuerdo entre la Comunidad Autónoma y cada concreta entidad local); y mediante modificaciones normativas que incluyan «reservas» funcionales o traslados competenciales
