El presente trabajo tiene por objeto abordar los problemas que está generando la confluencia entre los Tribunales Constitucionales, el Tribunal de Justicia de Unión Europea y el Tribunal Europeo de Derechos Humanos a partir de las experiencias española, alemana e italiana. Pero, antes de entrar en el detalle de esa triple confluencia, se apunta el contexto de constitucionalismo abierto y se trata de ajustar, en lo posible, el sentido de la recurrente expresión «diálogo entre Tribunales». Y se hace un somero repaso de la trayectoria de informal intercambio entre el TEDH y el TJUE.Finalmente, desde la perspectiva propia del TC español y de los otros dos Tribunales Constitucionales, asimismo, considerados, se esboza la respectiva trayectoria en su confluencia con el TEDH y el TJUE
The purpose of this paper is to address the problems that the confluence between the Constitutional Courts, the Court of Justice of the European Union and the European Court of Human Rights is generating from the Spanish, German and Italian experiences. However, before going into the detail of this triple confluence, we point to the context of open constitutionalism and try to adjust, as far as possible, the meaning of the recurrent expression «dialogue between Courts». And a brief made of the review is informal Exchange trajectory between the ECtHR and the ECJ.Finally, from the perspective of the Spanish Constitutional Court and the other two Constitutional Courts, the respective trajectory in their confluence with the ECtHR and the ECJ is outlined
