La presente investigación tiene por finalidad analizar la característica de la gravedad, como adjetivo fundamental del incumplimiento contractual, en el llamado derecho de opción del acreedor, que surge cuando el deudor incumple dolosa o culposamente su deber. This research aims to analyze the characteristic of gravity, as adjective fundamental breach of contract, in the so-called right of option of the creditor, which arises when the debtor fails willfully or culpably duty. Rivers of ink have been spilled in this matter, although its volumen almost always leads to the same ocean: the classical and scholastic view on the right of the creditor’s option. Particularly interested in establishing modern trends in this regard have been developed in the doctrine and jurisprudence of the Spanish legislation
