Buena parte de las acciones civiles entabladas en EEUU por demandantes extranjeros en relación con violaciones de derechos humanos ocurridos fuera del país, perpetradas por personas investidas de autoridad oficial en el momento de los abusos, o por empresas transnacionales o multinacionales, adopta la forma de class action. Este expediente procesal posee en el sistema estadounidense rasgos propios del que derivan ventajas para la litigación con el objeto descrito; sin embargo, no está exento de inconvenientes
