El tema de la tutela cautelar es un tema de gran relevancia teórica y práctica en el marco de un Ordenamiento Jurídico complejo, dominado por la lentitud y onerosidad de sus procesos y procedimientos. Esta lección se centra en el análisis de las medidas cautelares tributarias que se pueden adoptar en los procedimientos tributarios con una fi nalidad aseguratoria, sea a efectos del cobro de la deuda o a los efectos de la conservación de pruebas. Su reciente reforma en varios aspectos por la Ley 7/2012, de 29 de octubre, invita a reflexionar sobre los privilegios procesales de la Administración Tributaria que marcan su auténtica posición de supremacía.
This article is about the preventive or precautionary measures that can be adopted during administrative tax procedures. It is an important issue in our contemporary judicial systems, named by the slowness and burdensome of its procedures. The issue has been recently reformed in our General Tax Law by Law 7/2012, of the 29th of October and this reform invites us to think about how good it is to maintain administrative procedural privileges.
