Este trabajo se centra en el estudio del artículo 382 del Código Penal español, que regula los concursos entre los delitos contra la seguridad vial y los delitos de homicidio o lesiones que tienen su origen en aquéllos. Este precepto fue objeto de una importante reforma mediante la Ley Orgánica 15/2007, de 30 de noviembre, de modificación del Código Penal en materia de delitos contra la seguridad vial, y, si bien su redacción no se ha alterado en la reforma operada por la Ley Orgánica 5/2010, de 22 de junio, las novedades introducidas por ésta en otros artículos del Capítulo del Código Penal en el que se integra aconseja una revisión de su contenido, de su naturaleza y de los problemas interpretativos que genera.
This provision was extensively modified by the Organic Law 15/2007, of 30 November, on the amendment of the Penal Code on the subject of offences relating to road traffic. The Organic Law 5/2010, of 22 June, has not altered the wording of Article 382; nevertheless, since this Organic Law amends other Articles included in the same Section, it is advisable to discuss both the content and nature of Article 382, as well as the interpretation issues arising from it.
