Problemas concursales entre el delito de cohecho y otras figuras vinculadas a la corrupción pública

Abstract

En la lucha por combatir comportamientos delictivos vinculados con la corrupción pública el legislador español en los últimos años ha modificado los tipos penales relativos al delito de cohecho, un ilícito penal esencial en la represión de este tipo de conductas. Sin embargo, estos cambios han originado importantes problemas dogmáticos a la hora de aplicar esta figura delictiva, siendo uno de los más relevantes el relativo a la problemática concursal. Así, este trabajo de investigación pretende delimitar, en primer lugar, específicos comportamientos delictivos que pueden dar lugar a situaciones de concurrencia delictiva entre el delito de cohecho y otros delitos vinculados a la corrupción pública como son los delitos de tráfico de influencias, malversación de patrimonio público y financiación ilegal de partidos políticos. Además, finalmente, también se estudiarán bajo que requisitos entre estos delitos podrían darse situaciones concursales que sean directamente atribuibles a una persona jurídica.

In the fight against criminal behaviors linked to public corruption, in recent years the Spanish legislator has modified the criminal provisions relating to the offence of bribery, a criminal offence that is essential to the repression of this type of behavior. However, these changes have caused important dogmatic problems when applying this criminal figure, one of the most important being the problem of criminal concurrence. Thus, this research work aims to delimit, in first place, specific criminal behaviors that can give rise to situations of criminal concurrence between the crime of bribery and other crimes related to public corruption such as the offences of influence peddling, embezzlement of public funds and illegal funding of political parties. In addition, finally, the type of situations in which these offences could assume a criminal concurrence directly attributable to a legal person will also be studied.
