Se analizan en este trabajo las aportaciones realizadas por el profesor Fernando Valdés Dal-Re en relación a cuestiones fundamentales como el canon de constitucionalidad, el rechazo de la crisis económica como parámetro de valoración constitucional, el contenido esencial de los derechos constitucionales; la fuerza vinculante de los convenios o acuerdos colectivos derivados del art. 37 CE; la negociación colectiva y la libertad sindical; la distinta configuración de las representaciones sindicales y no sindicales; el contenido esencial del derecho al trabajo en su vertiente individual (art. 35.1 CE). El análisis se realiza a través del Voto Particular que formuló el profesor Valdés en el recurso de inconstitucionalidad núm. 5610-2012 interpuesto en relación con diversos preceptos de la Ley 3/2012, de 6 de julio, de medidas urgentes para la reforma del mercado laboral y que dio lugar a la Sentencia 8/2015, de 22 de enero de 2015, frente a la que discrepa Fernando Valdés en su Voto Particular.
This paper analyses the contributions made by Professor Fernando Valdés Dal-Re in relation to fundamental issues such as the canon of constitutionality, the rejection of the economic crisis as a parameter of constitutional assessment, the essential content of constitutional rights; the binding force of collective agreements or agreements derived from art. 37 EC; collective bargaining and trade union freedom; the different configuration of trade union and non-union representations; the essential content of the right to work in its individual aspect (art. 35.1 EC). The analysis is carried out through the dissenting opinion formulated by Professor Valdés in the appeal of unconstitutionality no. 5610-2012 filed in relation to various precepts of Law 3/2012, of 6 July, on urgent measures for the reform of the labour market and which gave rise to Ruling 8/2015, of 22 January 2015, against which Fernando Valdés disagrees in his dissenting opinion.
