El sistema de fuentes y su fundamento democrático

Abstract

Este trabajo analiza, treinta años después, el trabajo del profesor Francisco Balaguer sobre las fuentes del derecho. En la primera parte se indaga sobre la intención del libro en el momento en el que fue publicado, que consistió en dotar de cientificidad al estudio del derecho constitucional. Para ello se buscó un método adecuado con el que facilitar la aplicación de las reglas que organizan el poder. En la segunda parte, se analiza específicamente como el libro a estudio intentó introducir el principio democrático en el estudio del sistema de fuentes. Finalmente, en la tercera parte se reflexiona sobre los cambios acaecidos en nuestro sistema de fuentes (derecho constitucional sin constitución; constitución sin ley; constitución sin reforma) y la repercusión que tiene sobre el método de estudio.

This paper analyzes, thirty years later, the work of Professor Francisco Balaguer on the sources of law. The first part of the paper examines the intention of the book at the time of its publication, which was to make the study of constitutional law more scientific. To this end, a suitable method was sought to facilitate the application of the rules that organize power. The second part analyzes in concrete terms how the book under study attempted to introduce the democratic principle into the study of the system of sources. Finally, the third part reflects on the changes that have occurred in our system of sources (constitutional law without a constitution; constitution without law; constitution without reform) and their repercussions on the method of study.
