¿Existe un estatuto del consumidor vulnerable tras la reforma del Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios?

Abstract

El RDL 1/2021 y la posterior Ley 4/2022 introducen la noción de consumidor vulnerable en el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (en adelante, TRLGDCU), procedente de la normativa europea. La vulnerabilidad del consumidor ya se había tenido en cuenta en la legislación autonómica y sectorial, pero con esta reforma aparece por primera vez en una normativa general de carácter estatal. El legislador español adopta una noción amplia de vulnerabilidad, que puede tener origen no sólo en condiciones personales y económicas, sino también en circunstancias educativas o sociales. Sin embargo, el reconocimiento legal de la vulnerabilidad del consumidor no ha implicado el establecimiento de una protección transversal. Esto es, no hay en el TRLGDCU un estatuto general del consumidor vulnerable, sino que las previsiones del legislador se traducen en normas aisladas, relativas fundamentalmente a los deberes de información precontractual y con incidencia casi nula en la etapa de ejecución del contrato. Y, además, multitud de cuestiones de concreta protección se dejan al desarrollo reglamentario.

RDL nº 1/2021 and the subsequent Act nº 4/2022 introduce the notion of vulnerable consumer into the TRLGDCU, which comes from European legislation. Consumer vulnerability had already been taken into account in regional and sectorial legislation, but with this reform it appears for the first time in general state legislation. The Spanish legislator adopts a broad notion of vulnerability, which can originate not only in personal and economic conditions, but also in educational or social circumstances. However, the legal recognition of consumer vulnerability has not implied the establishment of a transversal protection. That is to say, there is no general statute of the vulnerable consumer in the TRLGDCU, but rather the legislator's provisions are translated into isolated rules, mainly relating to pre- contractual information duties and with almost no impact on the execution stage of the contract. Moreover, a multitude of specific protection issues are left to regulatory development.
