Medidas Fiscales frente al reto de la despoblación

Abstract

El desafío demográfico, y la despoblación, son desde hace ya tiempo uno de los principales problemas a que se enfrentan los pequeños municipios, y la ruralidad española. Con tasas de crecimiento vegetativo negativas, propiciadas por un intenso envejecimiento poblacional y escasa natalidad, España, se encuentra hoy ante la difícil situación de no poder garantizar la subsistencia demográfica de estos rincones de su territorio. Por esta razón, y con intención de ofrecer una visión de conjunto, nos proponemos realizar un estudio integral de la despoblación, desde el Derecho Financiero. Donde analizaremos, la importancia y características que presenta la despoblación en la actualidad, y cuales son las posibles soluciones que se pueden adoptar desde el Derecho Financiero para paliarla, haciendo hincapié en dos líneas de acción. Primero, desde el Derecho Presupuestario, atendiendo a las medidas de gasto público, que se han adoptado hasta el momento, y considerando las posibles mejoras que se podrían implantar en ellas. En segundo término, prestaremos especial atención, a la idoneidad del Derecho Tributario, como una vía de acción frente a la despoblación, comprobaremos la capacidad de los incentivos fiscales para atraer y retener población en el medio rural, así como estudiaremos las medidas de este tipo, que han adoptado hasta el momento por las diferentes administraciones territoriales.

The demographic challenge and depopulation have long been one of the main problems facing small municipalities and rural Spain. With negative vegetative growth rates, caused by an intense population ageing and a low birth rate, Spain today finds itself in the difficult situation of not being able to guarantee the demographic subsistence of these corners of its territory. For this reason, and with the intention of offering an overall view, we propose to carry out a comprehensive study of depopulation from the perspective of Financial Law. We will analyze the importance and characteristics of depopulation at present, and the possible solutions that can be adopted from Financial Law to alleviate it, with emphasis on two lines of action. Firstly, from Budgetary Law, looking at the public spending measures that have been adopted to date, and considering the possible improvements that could be implemented in them. Secondly, we will pay special attention to the suitability of Tax Law as a mean of action against depopulation, we will check the capacity of tax incentives to attract and retain population in rural areas, and we will study the measures of this type that have been adopted to date by the different territorial administrations.
