Las mujeres y el acceso a la propiedad de la tierra: aproximación histórico-comparativa

Abstract

El presente trabajo explora el desigual acceso a la propiedad por parte de las mujeres desde un enfoque histórico-comparativo. Partiendo de épocas anteriores iremos analizando los distintos impedimentos que se han ido imponiendo a las mujeres a lo largo de la historia a la hora de disponer de sus bienes. Especial mención merece el papel que los derechos consuetudinarios han desempeñado en cuanto a la transmisión de la tierra, como sucede entre los pueblos bereberes del norte de África, que practicaban la sucesión agnaticia. Así mismo, pondremos de manifiesto ciertos patrones comunes que se repiten en los paises musulmanes del norte de África y de Oriente Medio, favorecidos por leyes de inspiración islámica que fomentan el desigual reparto de la herencia en función del sexo del heredero. Todas estas trabas contribuyen a agrandar la brecha de género en materia de propiedad, dificultan la emancipación de la mujer y la hacen más proclive a sufrir los efectos de la pobreza.
